ข้อมติคณะมนตรีความมั่นคงแห่งสหประชาชาติที่ 827 มีมติเห็นชอบอย่างเป็นเอกฉันท์เมื่อวันที่ 25 พฤษภาคม พ.ศ. 2536 หลังจากยืนยันข้อมติที่ 713 (พ.ศ. 2534) และข้อมติในภายหลังทั้งหมดในประเด็นเกี่ยวกับอดีตยูโกสลาเวีย และอนุมัติรายงาน S/25704 ของเลขาธิการสหประชาชาติ บุฏรุส บุฏรุส-ฆอลี โดยมีระเบียบของศาลระหว่างประเทศเป็นภาคผนวก ซึ่งก่อตั้งศาลอาญาระหว่างประเทศในอดีตยูโกสลาเวีย[1]

เนื่องจากมีการละเมิดกฎหมายมนุษยธรรมระหว่างประเทศในอดีตยูโกสลาเวียอย่างต่อเนื่อง โดยเฉพาะอย่างยิ่งในบอสเนียและเฮอร์เซโกวีนา รวมทั้งการสังหารหมู่ การกักขังอย่างเป็นระบบ และการข่มขืนสตรี ไปตลอดจนถึงการล้างเชื้อชาติ ข้อมติดังกล่าวตกลงใจว่าสถานการณ์ได้เกิดเป็นภัยคุกคามต่อสันติภาพและความมั่นคงระหว่างประเทศ โดยประกาศเจตนาเพิ่มเติมว่าจะยุติอาชญากรรมดังกล่าวและนำความยุติธรรมกลับคืนแก่เหยื่อ[2] คณะมนตรีฯ ตัดสินใจว่าการก่อตั้งศาลพิเศษและการดำเนินคดีแก่บุคคลซึ่งรับผิดชอบต่อการละเมิดเล่านี้ โดยเป็นการยืนยันการตัดสินใจในข้อมติที่ 808 (พ.ศ. 2536)
