Ustav Srbije od 1990. godine

Ustav Republike Srbije iz 1990. godine je izbacio iz naziva Srbije prefiks "socijalistička", a pokrajini Kosovo je vraćen stari naziv Kosovo i Metohija. Uz to, Ustav je definitivno oduzeo pokrajinama u sastavu Srbije (Vojvodina, Kosovo i Metohija) sve elemente državnosti i potvrdio odluku republičkog parlamenta iz 1989. Po Ustavu, Predsednik Republike je uѕ Skupštinu najviša je vlast u zemlji. On predlaže Skupštini mandantara za sastav Vlade. Mandat predsednika traje pet godina. Skupština Srbije ima mandat četiri godine, i u njenom sastavu je 250 narodnih poslanika. Oni se, kao i Predsednik Republike, biraju na slobodnim,neposrednim i tajnim izborima.

Vlada je direktno odgovorna parlamentu, koji sa najmanje 126 poslanika može izabrati Vladu.

Prema članu 72, stav 1: "Republika Srbija uređuje i obezbeđuje: 1. suverenost, nezavisnost i teritorijalnu celokupnost Republike Srbije i njen međunarodni položaj i odnose s drugim državama i međunarodnim organizacijama".

Ustav iz 1990. godine prestao je da važi 8. novembra 2006. godine kada je Narodna skupština Republike Srbije proglasila novi Ustav, donesen kao odgovor na nove okolnosti (raspad Državne zajednice SCG i osamostaljenje Srbije, očuvanje teritorijalnog integriteta države itd.). Izglasavanju novog Ustava prethodio je referendum 28. i 29. oktobra 2006. kada su građani Srbije tesnom većinom glasali za donošenje novog najvišeg akta.
