Verdrag

'n Verdrag is 'n formele skriftelike ooreenkoms wat akteurs in die internasionale reg aangegaan het, naamlik soewereine state en internasionale organisasies.[1] 'n Verdrag kan ook bekend staan as 'n internasionale ooreenkoms, protokol, verbond, pakt, konvensie of briefwisseling, onder ander bepalings. Ongeag terminologie word slegs instrumente wat bindend is vir die partye beskou as verdrae onderworpe aan internasionale reg.

Verdrae kan losweg met kontrakte vergelyk word deurdat die partye gewillig bindend onder mekaar opneem, en enige party wat sy verpligtinge oortree, kan volgens die internasionale reg aanspreeklik gehou word.[2][3] Verdrae verskil wesenlik in inhoud en ingewikkeldheid, en dit kan 'n wye verskeidenheid aangeleenthede reguleer, soos territoriale grense, handel en transaksies, politieke alliansies, en meer.

Die internasionale reg oor verdrae is meestal gekodifiseer deur die Wenen-konvensie oor die Wet van Verdrae, wat die reëls en prosedures uiteensit vir die opstel, handhawing, wysiging en interpretasie van verdrae.[4] As een van die vroegste manifestasies van internasionale betrekkinge, word verdrae erken as 'n primêre bron van internasionale reg.[5]
