צ'ארלס דניאל דרייק (באנגלית: Charles Daniel Drake‏; 11 באפריל 1811 – 1 באפריל 1892) היה סנאטור ארצות הברית ממיזורי ושופט ראש בית המשפט לתביעות. דרייק היה ברציפות ויגי, לא יודע כלום ודמוקרט.

ביוגרפיה

השכלה וקריירה

דרייק נולד ב-11 באפריל 1811 בסינסינטי, אוהיו,[1] ולמד בסנט ג'וזף קולג' בבארדסטאון, קנטקי בשנים 1823 ו-1824, ובאקדמיה הצבאית של פרטרידג' במידלטאון, קונטיקט בשנים 1824 עד 1825.[1] הוא היה פרח קצונה בצי ארצות הברית מ-1827 עד 1830.[1] הוא למד משפטים עם בנג'מין דרייק בסינסינטי,[1] ולאחר מכן נכנס למשרד עריכת דין פרטי בסינסינטי מ-1833 עד 1834.[1] הוא המשיך בעריכת דין פרטית בסנט לואיס, מיזורי מ-1834 עד 1847, ולאחר מכן חזר לסינסינטי מ-1847 עד 1849.[1] הוא היה גזבר מועצת הנציגויות הזרות של הכנסייה הפרסביטריאנית בשנת 1849.[1] הוא חידש את עריכת הדין הפרטית בסנט לואיס מ-1850 עד 1867.[1] הוא היה חבר בבית הנבחרים של מיזורי מ-1859 עד 1860.[1] כמו כן, הוא היה ציר וסגן נשיא הוועידה החוקתית של מיזורי בשנת 1865.[1]

במהלך מלחמת האזרחים האמריקנית, דרייק הפך ליריב חריף לעבדות, ולמנהיג של הרפובליקנים הרדיקלים. מ-1861 עד 1863, הוא הציע ללא הצלחה שחרור מיידי וללא פיצוי של עבדים. הוא הובס על ידי הרפובליקנים השמרנים בראשות המושל המילטון רואן גמבל שנתמך על ידי לינקולן. עד 1863, דרייק ארגן את הפלג הרדיקלי שלו וקרא לאמנציפציה מיידית, חוקה חדשה ומערכת של שלילת זכויות של כל אוהדי הקונפדרציה במיזורי. הוא כיהן כסגן נשיא הוועידה החוקתית של המדינה משנת 1865, שם בלט כמנהיג הפעיל ביותר. מנהיג הגרמנים במיזורי, קארל שורץ, הגיב עליו, "בפוליטיקה הוא היה בלתי נמנע... רוב חברי מפלגתו, במיוחד במחוזות המדינה, התפעלו ממנו מאוד". החוקה החדשה אומצה ונודעה בשם "חוקת דרייק". הרדיקלים שמרו על שליטה מוחלטת במדינה מ-1865 עד 1871, עם דרייק כמנהיגם. כדי לשמור על השלטון, דרייק והרפובליקנים הרדיקליים שללו כל אדם שתמך בקונפדרציה, אפילו בעקיפין. הם הכינו רשימת פעולות של 81 נקודות. בית המשפט העליון של ארצות הברית הפך את הטלת השבועה על שרים, והפך לנושא פוליטי שנוי במחלוקת ביותר ברחבי המדינה. הרפובליקנים הגרמנים במיוחד כעסו. כדי לחזק עוד יותר את בסיס ההצבעה שלו, הוא הבטיח את זכות ההצבעה לכל הגברים השחורים במיזורי, למרות החששות של רפובליקנים רבים.

כהונה בקונגרס

דרייק נבחר כרפובליקני לסנאט של ארצות הברית וכיהן מ-4 במרץ 1867 עד 19 בדצמבר 1870, אז התפטר כדי לקבל תפקיד שיפוטי פדרלי.[2] הוא כיהן כיו"ר ועדת החינוך של הסנאט של ארצות הברית בקונגרס ה-41 של ארצות הברית.[2]

כהונה כשופט פדרלי

דרייק מונה על ידי הנשיא יוליסס ס. גרנט ב-12 בדצמבר 1870, למושב השופט הראשי בבית המשפט לתביעות (לימים בית המשפט לתביעות של ארצות הברית) שפונה על ידי השופט העליון ג'וזף קייסי.[1] הוא אושר על ידי הסנאט של ארצות הברית וקיבל את המינוי שלו באותו יום.[1] כהונתו הסתיימה ב-12 בדצמבר 1885, עקב התפטרותו.[1]

אחרית חייו ומותו

לאחר התפטרותו מכס השיפוט הפדרלי, דרייק חידש את העיסוק הפרטי בוושינגטון בין השנים 1885 עד 1892.[1] הוא מת ב-1 באפריל 1892 בוושינגטון הבירה[1] שרידיו נשרפו והאפר נטמן בבית הקברות בלפונטיין בסנט לואיס.[2]

משפחתו

אביו של דרייק, דניאל דרייק (1785–1852), היה רופא וסופר אמריקאי. דודו, בנג'מין דרייק (1795–1841), היה היסטוריון, עורך וסופר אמריקאי.
