One cannot steal data.. Theft is about taking away property, not about copying or taking away data..
It can be considered a service theft then. The data is being hijacked by unauthorized users for their own ends.
It doesn't matter what you all think of the accuracy, validity or legitimacy of the term data theft. First of all, if reliable sources approve of its use, it's good enough for Wikipedia. "In some countries this term is incorrect because it is considered that theft is of a thing (material object) and information is not a thing." Considering that "data theft" is an English phrase, I don't see what the laws of a Spanish speaking country have to do with anything.
